Information collected by cookies

We use cookies on the Website, and web analytics services and social media plug-ins to enhance your user experience. A cookie is a small text file on your computer which a website sends to your computer to allow the Website to store information which uniquely identifies their users. Our cookies do not collect or store personally identifiable information. Rather, the cookie stores a token which uniquely identifies a particular user at a particular time.

That token is then linked to the user information in our secured databases. You can always reset your browser to refuse all cookies or to display a message when a cookie is being sent. If you reset your browser, some of the Website features and functionality may not be available to you.

We invite you to thoroughly review our Cookie Policy.

Information collected by web beacons and log files

We also collect certain non-personally identifiable information through the use of web beacons and log files. Such information may include your IP address, browser type, site usage, and whether you opened emails you received from us.

How we secure your information

To protect your personal information, we take reasonable precautions and use commercially reasonable and generally-accepted technological safeguards to secure any information we collect about you, to ensure that it is not inappropriately lost, misappropriated, accessed, disclosed, altered or destroyed. The Secure Server Software (SSL) we use encrypts all information you input before it is sent to us. In addition, your user account information is password-protected for your privacy and security. You should always take steps to protect the confidentiality of the password you select.

We operate internationally, so our computer systems may be based overseas. As a result, your personal data may be processed in a location where data protection and privacy regulations may not offer the same high level of protection as in other parts of the world, however, we use our reasonable best efforts to grant the same protection standards as regulated in the European Union.

How do we share or disclose your information

Generally, we may only share your personal information with other subsidiaries or partner companies of the Netenders Group, and our trusted service providers and partners that carry out activities for us and give us support in the delivery of the information, and we do so with appropriate safeguards to ensure the security of your data.

Sometimes, in order to fulfill the purposes indicated in this Privacy Policy, it is necessary for us to give access to your personal data to third parties that provide us with support in the services that we offer you, which may in certain cases act as joint controllers, namely:

  • financial institutions;

  • fraud detection and prevention entities;

  • technology and analytics service providers;

  • providers and partners of logistics, transport and delivery services or their associated establishments;

  • providers of customer service-related services; and

  • providers and partners of marketing and advertising related services, such as advertising agencies, advertising partners or social networks.

In such cases, we require that these third parties agree to use the information solely for the purpose for which we provided it to them and in accordance with our Privacy Policy.

Due to service efficiencies, some of these service providers are located in territories that do not provide a high level of data protection equivalent to that of the European Union. In such cases, we inform you that we transfer your data with appropriate safeguards and always maintain the security of your data, as we use the most appropriate tools for international data transfer, such as Standard Contractual Clauses or any other relevant supplementary measures.

You have the right not to be subject to an individualized decision based solely on automated processing of your personal data, including profiling.

If you agree to this Privacy Policy, you expressly consent the international transfer of all the information you provide to us.

In the event that we are acquired by, or merged with, or sell or transfer all or part of our business or assets to, another company belonging or not to the Netenders Group, or carry out any other business activity as a result of a corporate reorganization, we may disclose your personal data to the potential recipient of the business or assets. In the event of such a sale or transfer, we will use reasonable efforts to ensure that the recipient treats the personal information you have provided to us in accordance with our Privacy Policy. In this case, we believe we have a legitimate interest based on the reorganization of our corporate structure.

If you sign up for a promotion offer or enroll in a service we offer in partnership with a third party, we may provide information (such as your name, email address, and account activity) to such third parties.

We may also release information when we, in our sole discretion believe that such release is necessary or appropriate to:

  • comply with law, government regulations, or Courts decisions;

  • comply with subpoenas, warrants, court orders, government investigations, or other legal process;

  • enforce or apply the terms of any of our user or license agreements;

  • investigate or respond to allegations of fraud, intellectual property infringement, or other unlawful activity;
